Apple appeals US ban on Apple Watch

Apple has filed an appeal to reverse the ban on sales of its popular Apple Watch Series 9 and Apple Watch Ultra 2 models in the US. The company is also seeking an emergency stay on the ban for at least two weeks while redesigned versions of the banned models are being considered. Apple strongly disagrees with the decision made by the International Trade Commission (ITC) and is working to ensure the watches can be returned to customers as soon as possible. The ban came after the ITC found that Apple had infringed on a patent for blood oxygen saturation technology owned by health tech firm Masimo. Apple’s attorneys argue that the company will suffer irreparable harm if the ban remains in place during legal proceedings. The Exclusion Order Enforcement Branch of US Customs and Border Protection is set to make a decision on the redesigned models on January 13, 2023, and Apple is urging the court to grant a stay until then.
