A Seattle judge has refused a motion by Amazon and Apple to dismiss a consumer anti-trust lawsuit that claims the two companies colluded to price Apple products on Amazon at the top end of the spectrum. The companies do not deny the existence of the agreement. A judge in Seattle, John C Coughenour, has stated that the argument of whether Apple and Amazon’s Global Tenets Agreement (GTA) has an effect on a relevant market and whether it imposes an unreasonable restraint of trade is “reserved for a jury.” Apple and Amazon argue that the two companies compete “at a vertical level” selling Apple products.
