Canadians have a ‘right to be forgotten’ on Google, Federal Court rules

Google’s search engine is subject to federal privacy law, according to a recent ruling by the Federal Court of Appeal. This paves the way for individuals to request the removal of their names from search results, also known as the “right to be forgotten.” The case originated from a complaint to the federal Privacy Commissioner from a man who claimed that outdated and inaccurate information about him online was causing personal harm. Google argued that it functions as an intermediary, comparable to libraries or convenience stores, and therefore should not be held responsible for the content it indexes. The case is expected to be taken to the Supreme Court of Canada.
