In response to a request for information regarding the decision-making process behind the proposed regulation on child sexual abuse material (CSAM), the European Commission has failed to disclose a list of companies that were consulted on the technical feasibility of detecting CSAM without undermining encryption. This lack of transparency has been deemed “maladministration” by the European Ombudsman. The issue of technical feasibility is a major point of contention in EU negotiations on the topic, with experts stating that it is currently not possible to detect CSAM in encrypted content. Concerns have also been raised about the regulation’s compatibility with existing EU laws and the Commission’s relationship with lobbyists.
