While the goal of protecting victims is commendable, the bill’s notice-and-takedown system poses threats to free expression, user privacy, and due process. The broad definitions in the bill could lead to censorship of lawful speech and create an internet censorship regime more expansive than the DMCA. Furthermore, encrypted services may be at risk, as complying with takedown requests could compromise user privacy. Existing laws already exist to address NCII, and Congress should focus on enforcing and improving these protections rather than implementing a potentially abusive takedown regime.
